California Divorce Eligibility Requirements
Before you can file for divorce in California, you must meet certain eligibility requirements:
- You or your spouse must have lived in California for at least six months
- You or your spouse must have lived in the county where the case is filed for at least three months
The eligibility requirements differ for legal separations and domestic partnerships. To file for a legal separation, you do not need to meet any residency requirements. The same applies to domestic partnerships registered in California.
Grounds for California Divorce
In certain states, spouses must cite specific grounds or reasons for seeking divorce. California, however, is a no-fault divorce state. This means that neither you nor your spouse needs to prove any wrongdoing to file for divorce. The only grounds for divorce in California are “irreconcilable differences,” which simply means that your marital relationship has broken down and there is no hope of reconciliation.
How Long Does Divorce Take?
It varies from one case to the next. If spouses agree on all terms of the divorce, the process can take at least six months. On the other hand, when spouses cannot immediately agree on child custody, property division, or spousal support, the process can take longer.
Will You Have to Go to Court for Your Divorce?
No, you do not always have to. In fact, our Simi Valley divorce lawyers frequently assist clients in settling divorces through negotiations and mediation. Doing so helps couples retain complete control over their divorce’s outcome and reduces the time and stress involved.
Of course, an amicable divorce is not always possible. There are many such cases where we must argue for our clients’ interests before a judge. Fortunately for those who choose us, we have decades of experience in law and excel at handling divorces in court.
