Understanding Paternity in California
California law defines paternity as the legal relationship between a father and child. Establishing paternity is relatively simple for married parents because it usually does not require legal action. However, it is much more complicated for unmarried parents, namely because they may need to acquire a court judgment of paternity.

How to Establish Paternity in California
Voluntary Declaration of Parentage
You and your co-parent may establish paternity through a Voluntary Declaration of Parentage (VDOP). This signed document acknowledges you or your co-parent as the father of your child. Often, parents sign a VDOP at the hospital after the birth of a child. However, you can sign the document after the fact if witnessed by a notary public or at a public agency, such as a local child support agency, registrar of births, superior court, welfare office, or family law facilitator.
Must You Go to Court for a VDOP?
No, you do not. However, you should be careful of signing a VDOP if you are unsure whether you or your co-parent is the child's father. By signing, you relinquish your right to genetic testing and a trial to determine paternity. Consulting a trusted lawyer about your options for determining paternity is advisable.
Can You Change Your Mind About a VDOP?
Yes, within 60 days of signing the original VDOP, you can submit a Rescission Form. Beyond these 60 days, you must request that a court cancel your VDOP.
